The following terms and conditions apply to all website design services, web development services, site maintenance services, and site backup services provided to the Client.
1. Acceptance
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote for a project or a maintenance agreement or website backup service, or renews a maintenance agreement or backup service then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
2. Permission and Copyright
The Client guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork provided for inclusion in a web site or app are either owned by themselves or that they have permission to use them. When final payment is received for a project, copyright is automatically assigned as follows: the Client owns the graphics and other visual elements for the project, the text content, photographs and other data provided, unless someone else owns them. We own the code and license it to them for use on only that project.
3. Liability and Warranty Disclaimer
We can’t guarantee that the functions contained in any web page templates or in a completed web site, or in any app, will always be error-free and we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site, any other web pages, or this app, even if you have advised us of the possibilities of such damages.
4. Website Backup Service
For all Client website backup services we use the Blogvault backup and restore service. Please read their terms of service to ensure you agree with them. While we will make every effort to restore your website from a backup as quickly as possible we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the inability to operate your web site.
5. Changes to these Terms and Conditions
We reserve the right to add, delete, or modify any provision of these Terms and Conditions at any time without notice.
